How to win a slip and fall case

Slip and fall cases rely heavily on circumstantial evidence and the case that you are able to present in court. As a slip and fall victim, there are a number of things that you need to do to present your case.

Your first step is to immediately report the case to the property owner and property managers. If you are able to get the names, telephone addresses and phone numbers of all the witnesses that saw you fall, then do so as soon as possible. To add to the circumstantial evidence that your lawyers will present in court, also consider taking photographs of the area where you fell. Preserve any physical evidence that you have (such as clothing that was stained or wet from the fall). These items can be tested to determine what kind of substance you may have fallen on. Many people assume that a statement by an employee will count as evidence in court, but this isn’t the case. If an employee runs up to you after you fall and says that they are sorry or that your fall was their fault, this will not necessarily be held against the employer or property owner.
